Terms of Service, Refund & Liability Policy

These Terms of Service (“Terms”) govern access to and use of all applications, services, websites, and platforms operated by GoGoLiberty Transport™, Altare Libertas LLC, and affiliated entities (collectively referred to as “GoGoLiberty,” “the Company,” “we,” “our,” or “us”).

These Terms apply to all users of the platform, including but not limited to:

  • Riders

  • Drivers

  • Couriers

  • GoGoMunch customers

  • Medical courier clients

  • Merchants and vendors

  • Website users

By accessing or using any GoGoLiberty platform, you agree to be bound by these Terms.

 

1. Platform Status

GoGoLiberty Transport™ operates as a technology platform that connects independent drivers, couriers, merchants, and customers.

GoGoLiberty does not directly provide transportation, delivery, or courier services.

Drivers and couriers are independent contractors, not employees of GoGoLiberty.

GoGoLiberty facilitates:

  • ride requests

  • delivery requests

  • courier shipments

  • payment processing

  • service coordination

The actual services are provided by independent drivers, couriers, or merchants.

 

2. User Eligibility

To use GoGoLiberty services, users must:

  • Be at least 18 years old

  • Provide accurate account information

  • Maintain a valid payment method

  • Follow all platform policies

GoGoLiberty reserves the right to suspend or terminate accounts at its sole discretion.

 

3. Payments and Charges

All services requested through the GoGoLiberty platform may include:

  • service charges

  • platform fees

  • delivery or transportation charges

  • taxes where applicable

Payments are processed through secure third-party payment processors such as Stripe or other financial service providers.

Users authorize GoGoLiberty to charge the selected payment method for all services requested through the platform.

All charges are final unless a refund qualifies under the Refund Policy below.

 

4. Refund Policy

Refunds are not guaranteed and are only granted under specific qualifying circumstances.

If a refund is approved, a non-refundable $5.00 processing fee will be retained by GoGoLiberty to cover platform and transaction costs.

 

4.1 Rider Refunds (Transportation Services)

A rider may qualify for a refund if:

  • Payment was processed but no driver arrived

  • A duplicate charge occurred due to system error

  • A ride was canceled due to platform malfunction

  • The rider provides verifiable evidence of service failure

Refunds will not be granted for:

  • rider cancellations

  • rider no-shows

  • incorrect pickup locations

  • traffic delays

  • dissatisfaction unrelated to service failure

Approved refunds will be issued minus the $5 processing fee.

 

4.2 GoGoMunch Refunds (Food & Grocery Delivery)

Refunds may be issued if:

  • An order was never delivered

  • The order was canceled after payment was processed

  • Delivery failure occurred due to courier error

Refunds will not be granted for:

  • dissatisfaction with food taste or quality

  • restaurant preparation issues

  • late deliveries due to traffic or restaurant delays

Approved refunds will be issued minus the $5 processing fee.

 

4.3 Driver App Refunds

Drivers using the GoGoLiberty platform are not eligible for refunds for any fees or costs associated with:

  • driver onboarding

  • platform services

  • subscription or service charges

  • participation on the platform

All driver-related fees are non-refundable.

 

4.4 Medical Courier Refunds

Refunds for medical courier services may be granted if:

  • the shipment was never delivered

  • the courier service was canceled prior to dispatch

  • a verified operational failure occurred

Approved refunds will be issued minus the $5 processing fee.

 

5. Loss, Damage, or Theft of Items

If any item transported through GoGoLiberty is:

  • lost

  • stolen

  • damaged

  • destroyed in an accident

The matter may be subject to insurance investigation rather than refund processing.

Possible insurance sources may include:

  • driver commercial insurance

  • courier liability insurance

  • merchant insurance coverage

  • third-party liability policies

GoGoLiberty does not guarantee reimbursement beyond applicable insurance coverage and policy limits.

 

 6. Accidents and Liability

Drivers and couriers operating through GoGoLiberty are independent contractors responsible for their own actions, insurance, and compliance with local laws.

In the event of:

  • vehicle accidents

  • cargo damage

  • delivery incidents

Liability may be determined through insurance providers, law enforcement reports, or legal review.

GoGoLiberty is not liable for damages caused by independent drivers or couriers.

 

7. Fraud Prevention and Refund Abuse

To maintain fairness across the platform, GoGoLiberty monitors refund activity.

Accounts may be flagged for abuse if they:

  • repeatedly request refunds

  • submit false claims

  • attempt to exploit the refund system

  • engage in fraudulent chargebacks

Accounts suspected of abuse may face:

  • refund denial

  • temporary suspension

  • permanent account termination

  • legal action if fraud is suspected

 

8. Chargebacks

Customers agree to contact GoGoLiberty support before filing chargebacks with banks or credit card providers.

Fraudulent chargebacks may result in:

  • account suspension

  • permanent platform ban

  • recovery actions for disputed funds

9. Limitation of Liability

To the maximum extent permitted by law, GoGoLiberty Transport™, Altare Libertas LLC, and its affiliates shall not be liable for:

  • indirect damages

  • incidental damages

  • lost profits

  • lost data

  • service interruptions

  • driver or courier misconduct

The total liability of GoGoLiberty for any claim shall not exceed the total amount paid for the specific service in question.

10. Account Suspension or Termination

GoGoLiberty reserves the right to suspend or terminate accounts for:

  • policy violations

  • fraudulent activity

  • abusive behavior

  • misuse of the platform

Termination may occur without prior notice if necessary to protect platform integrity.

11. Service Availability

GoGoLiberty does not guarantee:

  • driver availability

  • delivery completion times

  • continuous platform uptime

Service availability may vary based on:

  • geographic region

  • driver supply

  • weather

  • emergencies

  • technical maintenance

12. Policy Updates

GoGoLiberty may update these Terms at any time.

Updated policies will be posted within:

  • mobile applications

  • company website

  • official support pages

Continued use of the platform indicates acceptance of updated terms.

 

13. Governing Law

These Terms shall be governed by the laws of the State in which Altare Libertas LLC is registered, without regard to conflict-of-law principles.
